This is a contract between McDonald’s Kennels and the pet Owner making this reservation.
- Owner agrees to pay the rate for boarding in effect on the date the pet is checked into the kennel as posted in the office,
- Owner agrees to pay all costs and charges for services requested and all veterinary costs for the pet during the time said pet is in the care of McDonald’s Kennels
- The Owner further agrees that the pet shall not leave the kennel until charges have been paid in full or other arrangements have been agreed to by the Owner and McDonald’s Kennels.
- By signing this contract and leaving their pet with McDonald’s Kennel the, the Owner certifies to the accuracy of all information regarding the pet given to McDonald’s Kennels
- Kennel shall exercise reasonable care for the pet delivered by the Owner to McDonalds Kennels for boarding. It is expressly agreed by the Owner and McDonald’s Kennel that Kennel’s liability shall in no event exceed the lesser of the current chattel value of a pet of the same species or the sum of $200.00 per animal boarder. The Owner further agrees to be solely responsible for any and all acts of behavior of said pet while it is in the care of McDonald’s Kennels.
- Owner specifically represents to McDonald’s Kennel that he/she is the sole owner of the pet, free and clear of all liens and encumbrances.
- Owner specifically represents to the Kennel, that the pet has not been exposed to All charges incurred by Owner shall be payable upon pick up of pet, or when billed by McDonald’s Kennels at the address listed in the client’s record. The pet shall not be released to Owner until all charges are paid, or payment arrangements have been made to fully discharge the debt to McDonald’s Kennels. McDonald’s Kennels shall have, and is hereby granted, a lien on the pet for any and all unpaid charges resulting from boarding pet at McDonald’s Kennels. The Owner hereby agrees that in the event all charges are not paid when due McDonald’s Kennels may exercise its lien rights upon ten days written notice given by McDonald’s Kennels to Owner by certified mail to the client’s address. McDonald’s Kennels may dispose of pet for any and all unpaid charges at private or public sale, in the sole discretion of the Kennel, and the Owner specifically waives all statutory or legal rights to the contrary. If such sale shall not secure a price adequate to pay such costs of boarding or other charges, delinquent, plus the cost of sales, then Owner shall be liable to McDonald’s Kennels for the difference. All monies realized by McDonald’s Kennels above and beyond the cost of boarding and expenses shall be paid by McDonald’s Kennels to the Owner.
- If pet becomes ill or if the state of the animal’s health otherwise requires professional attention, McDonald’s Kennels, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the animal and the expenses thereof shall be paid by the Owner.
- This contract contains the entire agreement between parties. All terms and conditions of the Contract shall be on the heirs, administrators, personal representatives and assigns of the Owner and McDonald’s Kennels.
- Any controversy or claim arising out of or relating to this contract, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any Party to this contract shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator will be entered in any Court with jurisdiction in Kitsap County WA. In the event of any arbitration or litigation concerning this agreement, the prevailing party shall be entitled to recover their reasonable attorneys’ fees and costs.
